Sharia evaluation concerning the proclamation of the Caucasus Emirate, based on the Koran and the Sunna of Prophet Muhammad (peace and blessing of Allah be upon him).

 

In the name of Allah, Most Beneficent, Most Merciful!

 

Praise be to Allah, the Lord of the Worlds, and may until the very Day of Resurrection blessings and peace abide over the worthiest of His Messengers and last of his Prophets, truthful and faithful Muhammad (peace and blessings of Allah be upon him), who was sent to both Whites and Blacks, over members of his family and his disciples, who picked up the banner of Islam, over the Imams and Rulers, and those who dedicated their lives to the call of Islam, over the God-fearing and the righteous, who followed them with pure hearts, and also over all of those who followed their path!

 

Unification of Muslims is a duty of each Muslim

 

"And hold fast by the covenant of Allah all together and be not disunited, and remember the favor of Allah on you when you were enemies, then He united your hearts so by His favor you became brethren; and you were on the brink of a pit of fire, then He saved you from it, thus does Allah make clear to you His communications that you may follow the right way." (The Family of Imran 103)

 

Expansion of the boundaries of the Islamic State is a sacred duty of each Muslim

 

Prophet Muhammad (peace and blessings of Allah be upon him) would send his envoys for calling to Islam and gathering Zakat (charity) for the needy. Envoys such as Muaz bin Jabal, Ali bin Abi Talib and Abu Musa Ash-Ari. And what Prophet Muhammad (peace and blessings of Allah be upon him) had done, is the Sunna for all Muslims, and whoever denies it becomes a kafir (an infidel).

 

"So take what the Messenger assigns to you, and deny yourselves that which he withholds from you." (Banishment, 7)

 

"It is not fitting for a Believer, man or woman, when a matter has been decided by Allah and His Messenger to have any option about their decision: if any one disobeys Allah and His Messenger, he is indeed on a clearly wrong Path." (The Clans, 36)

 

Disciples of Prophet Muhammad (peace and blessings of Allah be upon him) headed for different countries after his death. They left their families in order to expand the boundaries of the State. Their goal was to bring the word of Allah to the people and to establish Caliphate on Earth.

 

Disciples from Mecca and Medina took their own initiative to head for other countries in order to expand the territory of Islam.

 

During the rule of Umar the disciples reached Derbent, while striving on the path of Allah, and they were bringing the true word of Allah to the people.

 

(Islamic historians believe that Chechens and a number of other nations of the Caucasus adopted Islam during the rule of Caliph Umar. Historical sources point out that the disciples reached a non-aggression agreement with the highlanders, because there were some of them who would conduct plundering forays.) To Muslims it is a sacred duty to follow the disciples and Prophet Muhammad (peace and blessings of Allah be upon him). This is what was said to us by Prophet Muhammad (peace and blessings of Allah be upon him) in his Hadith.

 

"Hold on to my Sunna and the Sunna of my disciples (Aby Bakr, Umar, and Ali, may Allah be pleased with them), who are endowed by Allah with the right leadership of their affairs. And hold on to this Sunna with your molar teeth." (Daud, Tirmizi, Ahmad, et al.)

 

"He that holds fast to my Sunna in the moment of immorality among my Ummah (Nation), he will receive the reward of a hundred Martyrs (Shuhada)." (Al-Ibanatul Kubro Ibn Batta)

 

A merger of two or several nations into one Islamic state - this is the entire path of Prophet Muhammad (peace and blessings of Allah be upon him).

 

All learned Ulama (Islamic scholars) are unanimous that the aim of Islam is to establish the Islamic State on Earth, where the only one law, the Law of Allah, would apply. Because the State is a part of Islam.

 

Prophet Muhammad (peace and blessings of Allah be upon him), after the Hijra from Mecca to Medina, started building the State right away. The document of brotherhood between Muhajirs and Ansars was signed. Then the non-aggression pact between the Muslims and the Jews of Medina was signed. From the above-mentioned it follows that the unification for any Muslim leader is a mandatory condition, provided there is an opportunity and Maslaha for Muslims. The proof is in the words of the Almighty Allah:

 

"And surely this your religion is one religion and I am your Lord, therefore be careful (of your duty) to Me." (The Believers, 52)

 

"And be not like those who became divided and disagreed after clear arguments had come to them, and these it is that shall have a grievous chastisement." (The Family of Imran, 105)

 

"And hold fast by the covenant of Allah all together and be not disunited, and remember the favor of Allah on you when you were enemies, then He united your hearts so by His favor you became brethren; and you were on the brink of a pit of fire, then He saved you from it, thus does Allah make clear to you His communications that you may follow the right way." (The Family of Imran, 103)

 

"O you who believe! Obey Allah and obey the Apostle and those in authority from among you; then if you quarrel about anything, refer it to Allah and the Apostle, if you believe in Allah and the last day; this is better and very good in the end." (The Women 59)

 

"And We have revealed to you the Book with the truth, verifying what is before it of the Book and a guardian over it, therefore judge between them by what Allah has revealed, and do not follow their low desires (to turn away) from the truth that has come to you; for every one of you did We appoint a law and a way, and if Allah had pleased He would have made you (all) a single people, but that He might try you in what He gave you, therefore strive with one another to hasten to virtuous deeds; to Allah is your return, of all (of you), so He will let you know that in which you differed;" (The Dinner Table, 48)

 

"And that you should judge between them by what Allah has revealed, and do not follow their low desires, and be cautious of them, lest they seduce you from part of what Allah has revealed to you; but if they turn back, then know that Allah desires to afflict them on account of some of their faults; and most surely many of the people are transgressors." (The Dinner Table 49)

 

The proofs that the boundaries of the Islamic territory must be expanded and the Muslims unified are infinite. And whoever denies it or doubts it, he thus oversteps the boundaries allowed by Allah and His Prophet Muhammad (peace and blessings of Allah be upon him), and only eternal hell is what is behind these boundaries. May Allah keep us from His wrath.

 

Based on what was stated above, the Muslim leader has every right to proclaim and Emirate or Imamate of two or several nations (countries/states), if he deems it necessary or as a Maslahat for the Muslims. The Sunna of the Prophet (peace and blessings of Allah be upon him) commands to elect an Amir from among the worthy, take an oath and obey by following the Sharia. Otherwise the community will get mired in lawlessness, anarchy and insubordination.

 

Subordination to the Amir's decisions is mandatory for all Muslims, as long as it does not contradict the Koran and the Sunna.

 

The Most High said:

 

"O you who believe! Obey Allah and obey the Apostle and those in authority from among you... " (The Women 59)

 

Prophet Muhammad (peace and blessings of Allah be upon him) said:

 

"He that obeys his Amir, obeys me. He that obeys me, obeys Allah." (Ahmad)

 

"Kill the one who will try to divide your group (Jamaah), while you gave preference to one." (Amiru)

 

"He that obeys his Amir, obeys me. He that does not obey his Amir, does not obey me." (Ahmad)

 

"Obey the Amir, even if he is one from among the Habashite servants. If Amir hits you, be tolerant, if he orders, be patient, if he deprives you of something or prohibits you something, be patient. If he treats you unjustly, be patient, if he orders you to do something that harms or diminishes your faith, then tell him that only your blood listens and obeys him, but not your faith." (As-Sananul Kubro)

 

Ibn Abbas tells on behalf of Messenger of Allah (peace be upon him): "May one who would not like anything (out of the deeds) of his ruler, show patience, for, indeed, one who disobeys the ruler (even) for a single inch, will die the way they used to die during the times of the Jahilia!" (Bukhari, Muslim)

 

During his last Hajj, Messenger of Allah (peace be upon him) addressed to the people and said: "If they appoint you a Black slave as an Amir, and if he will be ruling over you by the Book of Allah, listen and obey him." (Muslim) But if an Amir orders and calls for something that contradicts the Sharia or to some sinful deeds, then he cannot be obeyed.

 

Abdullah Ibn Umar tells on behalf of the Messenger of Allah (peace be upon him): "If an Amir orders but sinful deeds, there is no obedience, no subordination to him." (Bukhari, Muslim).

 

If an Amir oversteps the boundaries of the Faith and the Sharia, and gets mired in sinful deeds, then the Muslims are supposed to call him to the good and to caution him against the things reprehensible. If an Amir shows unbelief (kufr, infidelity), then he cannot be obeyed and stay as an Amir. Each Muslims must fight against him. Yet at the same time Allah warns in the Holy Koran: "The response of the believers, when they are invited to Allah and His Apostle that he may judge between them, is only to say: We hear and we obey; and these it is that are the successful." (The Light, 51)

 

There are infinite proofs from the Koran and the Sunna of Prophet Muhammad (peace and blessings of Allah be upon him), which demand that the Muslims obey the Amir and that the Amir has every right to make any decision that is a Maslaha for the Muslims, as long as it does not contradict the Koran and the Sunna.

 

Let us stop at that, because any one, who claims to be a Muslim, will consider it sufficient. Salam Aleikum wa Rahmatulla wa Barikatuhu
